Supplemental Notice for Teradata AI Features

Teradata’s artificial intelligence-related tools, models, and/or features (each, an “AI Feature”) are part of the Software and/or Service licensed to you under your existing agreement with Teradata. This notice provides additional details about how AI Features behave, how your data is handled when you use them, and other points to be aware of before enabling an AI Feature. To the extent anything in this notice conflicts with your underlying agreement, this notice controls with respect to the AI Feature.

1. Autonomous Operation and Access

AI Features may operate autonomously and will use the access rights, permissions, and credentials you provide to them. You are responsible for ensuring that such access is appropriate and limited to what your use case requires. Teradata is not responsible for actions an AI Feature takes within the scope of the access you have granted.

2. Reliability of Output

AI Features are probabilistic. They generate results (“Output”) based on patterns, which means Output may be inaccurate, incomplete, or unsuitable for your purpose, even when it appears authoritative. You should not rely on Output without independent verification, and there is no guarantee that any human is reviewing the AI Feature’s actions or Output. Determining whether an AI Feature is suitable for a particular purpose is your responsibility. Use of Output is at your sole risk, and Teradata makes no warranty that Output will be accurate, complete, reliable, or fit for any particular purpose.

3. Third-Party Services

AI Features rely on third-party and open-source tools, services, and components (the “Third-Party Services”). Each Third Party Service is licensed to you subject to the applicable license terms accompanying it, included in/with it, referenced in it, or otherwise entered into by you with respect to it.

4. Data Processing

Unless you are hosting the underlying Third-Party Service (for example, a large language model) entirely within your own controlled environment where the AI Feature resides, queries you submit to the AI Feature will leave your environment and be sent to a Third-Party Service for processing under that provider’s terms. In such cases, the Third-Party Service acts as your processor on your behalf, not as Teradata’s sub-processor. The data processing and data security provisions in your underlying agreement with Teradata do not apply to the connection between Teradata and the Third-Party Service, or to any processing performed by the Third-Party Service. As the controller of your data, you are responsible for determining what data to submit and for what purposes.

In some cases, the Third-Party Service that supports an AI Feature may not be available in your local deployment region. Where that occurs, the AI Feature may instead rely on a Third-Party Service deployed in a different region or in a global deployment, with the result that your queries and related data may be transferred to and processed outside of your local region. In these cases, in order to continue using the AI Feature, your administrator may need to submit a change request and consent to the cross-region or global processing of your data.

5. Output, Ownership, and Training

As between you and Teradata, you own the Output generated by an AI Feature, to the extent permitted by applicable law and the terms of any Third-Party Service involved. Teradata itself will not use your data to train the AI Feature. If you provide Teradata with feedback or suggestions regarding an AI Feature, Teradata and its affiliates may use that feedback without restriction or obligation to you.

6. Telemetry

Teradata collects and analyzes data relating to the provisioning, use, and performance of AI Features (“Telemetry Data”) for diagnostic, support, and corrective purposes. Where an AI Feature is offered on a consumption or usage basis, Telemetry Data is also used to meter your usage and calculate the applicable fees.

7. Regulatory Compliance

You are responsible for ensuring that your use of AI Features complies with all applicable laws and regulations, including the European Union AI Act, other AI-specific laws, privacy laws, export controls, and any sector-specific requirements that apply to you. You are responsible for assessing your obligations and implementing appropriate safeguards.

8. Support and Pricing

Any custom support, professional services, or fees associated with an AI Feature will be described in or referenced to in the applicable contract or order form between You and Teradata. For pre-general-availability releases, any consulting, technical assistance, installation, training, support, or maintenance services are provided at Teradata’s discretion and may be modified or discontinued at any time. The fee, tax, and payment terms in your underlying agreement otherwise apply.

9. Pre-General Availability Releases

If an AI Feature is made available to you for evaluation prior to general availability, the following also apply:

  • The AI Feature is experimental, has not been fully tested, and may contain errors and bugs.
  • Teradata does not commit that a commercial version of the AI Feature will be released.
  • Teradata has no obligation to provide support.
  • The AI Feature is provided “AS IS,” without express or implied warranties of any kind, including warranties of merchantability, fitness for a particular purpose, non-infringement, or data security.
  • Teradata and its affiliates are not liable for any damages of any kind (including, without limitation, lost profits, business interruption, or loss of information) arising out of your use of, or inability to use, the AI Feature, even if Teradata has been advised of the possibility of such damages.
